The Finanzoo.de portal is an offering by Finanzoo GmbH (hereinafter also referred to as the "operator"). Finanzoo GmbH provides the Finanzoo portal via the domain www.finanzoo.de. The following terms and conditions govern the terms of use of the finanzoo.de portal.

§ 1 Validity, contracting parties

These terms and conditions also apply if the portal is used from outside the Federal Republic of Germany. The contract is concluded with Finanzoo GmbH, Maxfeldstr. 69, 90409 Nürnberg, Germany. Authorized managing director: Mr. Thomas Jahn. Commercial register number: HRB 33067, Amtsgericht Nürnberg.

§ 2 Scope of services – essential features of the service

Finanzoo offers registered subscribers access to a database for fundamental analysis of internationally listed companies. The evaluation is based on mathematical algorithms and our proprietary FScore®.

A free 7-day trial period is available. The offered functions can be used during this trial period. The trial membership ends automatically after 7 days without any need for cancellation.

Personal advice or recommendations to buy or sell stocks are not part of the service.

§ 3 Steps to conclude the contract, start of the contract

Before concluding a paid subscription, the user receives an overview of the order with the service features, contact details, billing address and payment method. The paid contract is concluded upon successful confirmation of payment by our payment service provider (Stripe or, for cryptocurrency payments, NOWPayments); the paid area is activated automatically immediately after this payment confirmation.

A contract is only concluded if the member is at least 18 years old.

§ 4 Prices

Use of the 7-day trial subscription is free of charge. Further use requires one of the following paid subscriptions, each including statutory VAT:

Premium: currently 19,99 € per month
Business: currently 119,00 € per month, including API access

API access included in the Business subscription is subject to separate usage terms: usage is limited to a reasonable quota (number of requests per time unit) shown in the customer area. Sharing the API key or data obtained via the API with third parties without the operator's prior written consent is prohibited. The operator strives to ensure high availability of the API but does not provide any guarantee beyond Section 10 of these terms.

There is no guarantee for the accuracy or completeness of the data provided via the API (including metrics, scores and other fundamental data). Use of the API and the data obtained through it is at the customer's own risk. Further details can be found under Legal Notices & Risk Disclaimer.

§ 5 Payment terms

The fee for the selected subscription period is payable in advance without deduction. The available payment methods are displayed on the order page.

§ 6 Data protection

The operator's privacy policy and cookie policy apply, available at https://www.finanzoo.de/en/privacy-policy.html.

§ 8 Minimum terms, automatic renewal, termination of membership

The term of the paid subscription is indefinite but lasts at least one month. The subscription automatically renews for a further billing period unless terminated in good time. Termination is possible at any time, effective monthly at the end of the current billing period. You can use the permanently available cancellation button "Cancel subscription", accessible without login at finanzoo.de/en/cancel.html.

After termination of the subscription, user data may remain stored for 12 months to enable renewed registration with the same usage data.

§ 9 Termination of free membership, extraordinary termination

The free membership can be terminated at any time without notice. The right to extraordinary termination remains unaffected for both contracting parties.

§ 10 Liability of the operator

The operator's liability is unlimited for intent and gross negligence, as well as under the German Product Liability Act. The operator is likewise liable without limitation for injury to life, body or health resulting from an intentional or negligent breach of duty by the operator, its legal representative or vicarious agent.

In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), the fulfillment of which makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely, the operator's liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded. Liability for slightly negligent breaches of duty is otherwise excluded.

Within the above framework, Finanzoo GmbH accepts no liability for intentionally or negligently false statements by third parties, or for the accuracy and completeness of external data. The same applies to outages beyond its control, for example as a result of force majeure or technical disruptions of the internet.

§ 11 Obligations of the member

Members are obliged to provide truthful information, comply with applicable laws, protect their access data and refrain from any misuse.

§ 12 Prohibition of commercial use / spamming

Advertising or messages for commercial purposes referencing Finanzoo are prohibited. This also applies to corresponding links or emails to other members.

§ 13 Copyrights

For content created during the membership, the member grants the operator a non-exclusive, spatially unrestricted right of use for the operation of the portal. The member warrants that no third-party rights are infringed as a result.

§ 14 Information on the distance selling contract

The contract language is German. The contract text is not stored by the operator. These terms and conditions can be saved or printed out at any time.

§ 15 Right of withdrawal for consumers

Withdrawal notice

Consumers have a statutory right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Finanzoo GmbH, Maxfeldstr. 69, 90409 Nürnberg, Germany, email: service@finanzoo.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, although it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

To exercise your right of withdrawal, you may also use our permanently available "Withdraw from contract" button, accessible without registration or login at finanzoo.de/en/withdrawal.html. Upon receipt of your withdrawal, we will send you an immediate acknowledgement of receipt on a durable medium (Section 356a BGB) by email.

If, during the ordering process, you expressly requested that we begin performance of the service before the end of the withdrawal period, your statutory right of withdrawal remains unaffected; however, the following rules on compensation for value apply.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

Expiry of the right of withdrawal

In the case of a contract for the provision of services, the right of withdrawal expires prematurely if we have fully performed the service and have only begun performance after you gave your express consent and at the same time confirmed your knowledge that you will lose your right of withdrawal upon full performance of the contract by us.

§ 16 Changes to the General Terms and Conditions

The operator may amend these terms and conditions within the legally permissible framework. Changes will be communicated by email at least one month before they take effect. Where applicable, a special right of termination exists.

§ 17 Final provisions

German law applies. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
